Terms and conditions

Please read the following points carefully, as any purchase of products you may make means that you agree to them.

You can order products displayed on this website by completing all product ordering steps on-line or by calling us directly.  

If you have placed your order on-line an e-mail will be sent to you confirming that we have received your order. The e-mail confirmation will be sent to you within 24 hours enabling you to check the details of your order.  

Your statutory rights are not affected.

1.1 Application of Conditions
Any and all materials, be they herbs, spices, nuts, confectionery etc. ("the Goods") sold by Kitchen Guru Co. Ltd ("the Company", "we", "us") are sold under these conditions unless it is otherwise clearly stated in writing under a separate contract. These Conditions will apply to the exclusion of any terms or conditions put forward by the Customer. No conduct by the Company will be deemed to constitute the acceptance of any terms or conditions other than these Conditions.  

1.2 Our responsibility
We will not be responsible for any losses resulting from your use or the inability to use our website or resulting from unauthorised access to, or alteration of your transmissions of data in circumstances which are beyond our control. If you are unsure of the website ordering process please contact us directly and we can take your order over the telephone.  

We will not be responsible for your loss of profits, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.  

You will be responsible if you use this website in breach of these terms of use and will reimburse us for any loss that you cause to us as a result of your misuse.

We try our utmost to make sure our website will be uninterrupted and error free. However, due to the nature of the Internet, the shopping online service is provided on an "as is" and "as available" basis. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.  

You may view, copy and print portions of our website for the sole purpose of placing an order with us. The materials on our website may not be used for any other purpose.

Our website contains links to other websites which are not under the control of and are not maintained by us. These links are provided for your convenience only and we are not responsible for the content of those sites.  

1.3 Orders:  
All orders are subject to acceptance by Kitchen Guru Co. Ltd and such acceptance is conditional upon customer's acceptance of Kitchen Guru standard terms and conditions of sale.

1.4 Price
Prices are subject to change without notice.

1.5 Price Lists and Sales Literature
Prices given in our price lists or other sales literature are for information purposes only, and do not constitute an offer. No contract will come into existence until the Customer's order (however given) is accepted. Invoices will be raised for prices current at the time of order.  

1.6 Prices and Availability
Prices are as shown on our website.  

We try to make sure that the prices on our website are accurate but we will need to validate the price before we process your order. We also aim only to display items which are in stock or an approximate date when stock will be available.

If we are unable to supply a particular item which you have ordered we will notify you as soon as possible after receiving your order. If this happens, you may cancel your order and we will refund you any money which you have paid.  

1.7 Shipping Terms
All Kitchen Guru shall be shipped upon receipt of payment or clearance of monies due.  

1.8 Carriage  
Except as otherwise stated in any quotation or price list of the Company, or as otherwise agreed in writing, all prices are given by the Company on an ex-works basis and exclude transport.  

1.9 Delivery
Any dates quoted for delivery are approximate only. We will use reasonable endeavours to effect delivery on agreed dates based on information available at the time of quoting; however we accept no responsibility for any loss resulting from delays to delivery or from any deterioration in quality resulting from such delays.  

We can deliver goods to destinations within and outside the UK.  

All orders will be dispatched at the cost prescribed on the order form. If your delivery address is outside the UK there are varying delivery charges that will be calculated and displayed before you place your online order. Prices for delivery within the UK vary depending on the weight and total value of the order being placed.

We can usually deliver goods to destinations in the UK either next day or within 48 hours. However, to give a margin of safety, please allow up to 5 working days for delivery. In the unlikely event that we were unable to supply within this timeframe, we would notify you as soon as possible. For international orders please allow up to 10 working days. As large parcels will have to be signed for, please ensure there is someone available at the delivery address.  

We will make every effort to deliver within these timescales but we will not be liable for any loss caused to you by late delivery. If the goods are not delivered within the delivery, please contact us by telephone or email. We will try and ensure that you receive your order, as quickly as possible, or if you wish you may cancel your order and we will refund you any money which you have paid.  

1.10 Credit
Kitchen Guru terms are 30 days net with approved credit from date of invoice. No discounts.

1.11 Payment
For non account Customers payment is required in cleared funds before despatch. For account Customers payment is due within 30 days of receipt of order and time for payment is of the essence.  

You can pay by Visa and MasterCard credit card or by Switch, Delta or Solo debit card. To ensure that shopping on-line is secure, your credit/debit details will be encrypted using our secure server to minimise the possibility of someone being able to read your details as they are sent to us over the Internet.

Kitchen Guru Co. Ltd  in no way aggregate or store any customers credit card details when orders are placed online. This guarantees you a higher level of security for your personal details. For full details of our customer privacy policy please read our privacy policy here.

If your delivery address is outside the UK and you order online you must pay by credit card.  

1.12 Late Payments
Any sums not paid within the terms are subject to a service charge of one and one half percent (1.5%) per month. Accounts sixty (60) days past due may be placed on a C.O.D. basis.

1.13 Ownership of goods
Goods remain the property of Kitchen Guru Co. Ltd until paid for in full. Risk passes on delivery of the Goods. We may not sue for the price of the Goods notwithstanding that ownership has not passed.  

1.14 Damaged Goods & Short Orders  
Any claim that goods have been delivered damaged, are not of the correct quantity or do not comply with their description must, unless notified to the carrier at the time of delivery, be notified by the Customer to the Company in writing within 3 days of their delivery.  

1.15 Storage
We will be under no liability for any defect in the Goods (including, but not limited to, infestation or mould) arising from incorrect storage by the Customer. Goods supplied as dried herbs will remain active for long periods when stored under optimum conditions. They should be kept in air-tight, opaque containers in a cool, dry place and out of direct sunlight.  

1.16 Quality
Every effort is made to ensure that the Goods supplied are of high quality and in good condition. If we are fully satisfied that the products have been stored under optimum conditions and the Customer is not fully satisfied with their quality, we will, at our own discretion, refund the cost or exchange the goods up to three months from the date of delivery. The Company must be afforded a reasonable opportunity and facilities to investigate any claims made under this condition.

1.17 Seasonal Shortages & Out of Stock Products.
Please note that some herbs are subject to seasonal shortages. While every effort is made to keep our complete range of products in stock, we do not accept any responsibility for loss resulting from any out of stock items.

1.18 Product Suitability.
Our products are used for a wide variety of purposes. It is the responsibility of the Customer to ensure that the products are appropriately used. All representations, warranties, conditions or terms relating to the fitness for purpose are excluded to the fullest extent permitted by the Law and the Company accepts no liability.

1.19 Accounts
ninety days (90) days past due may be placed in collections and collection cost and/or court costs will be added.

1.20 Returns of Goods
Kitchen Guru Co. Ltd reserves the right to inspect all damaged goods. Written authorisation for product return is required.  

1.21 Returns
You may return an ordered and correctly supplied item(s) to us subject to the following conditions:

Subject to the above conditions we will provide refund less any credit / debit card expenses and original postage expenses. It will be the customer’s responsibility to arrange return posting. No liability will be accepted by Kitchen Guru Co. Ltd for returned goods that are either lost in transit or damaged in transit. Proof of posting is advisable.  

Please telephone, fax or e-mail us first and we will let you know how you should send the item to us.  

1.22 Claims
Claims for price, promotion, shipping adjustments, returns and transfers must be submitted with two (2) weeks of invoice date.  

Account Shipping Information

  1. Orders up to 10 cases per SKU received from Monday through Sunday, shipped following Tuesday.
  2. Orders more than 10 cases per SKU will be given a special shipping date upon receipt of the order. ( Usually 14 day lead time).

1.23 Force Majeure
The Company shall not be responsible for any loss to the Customer resulting from delivery being affected by war, strikes, fire,  changes in government policy, act of God or any other circumstances beyond its control.  

1.24 Consequential Loss
In no event will the Company be under any liability whatsoever to the Customer for any loss of profit, business, contracts, revenues or anticipated savings, or for any indirect or consequential loss and/or expense (whatever the cause, including negligence) suffered by the Customer.  

1.25 Insolvency of Customer
If the Customer fails to make payment when due or makes any arrangements with its creditors or becomes bankrupt or goes into liquidation (or the Company reasonably comprehends that these events are about to occur) we may in our absolute discretion suspend all further deliveries of goods and/or terminate the contract without liability on the Company's part. If the Goods have been delivered but not paid for, the price will become immediately due and payable.  

1.26 Consumer Transactions
Where the Goods are sold under a consumer transaction (as defined by the Consumer Transactions {Restriction on Statements} Order 1976) the statutory rights of the Customer are not affected by these Conditions.

1.27 General
We may change or withdraw any part of our website, or may refuse you access to the website at any time if we consider it necessary.

These terms are governed by the laws of England and Wales and any disputes will be decided only by the courts of England and Wales.
